• NightHawk Radiology Holdings (Coeur D'Alene, Idaho) said it has appointed one of its board members, Timothy Mayleben, as its executive VP and chief operating officer. As a consequence of the appointment, the company does not comply with NASDAQ rules, which require that NightHawk's board of directors consist of a majority of independent directors and that its audit committee have at least three independent directors. NightHawk provides radiology services to radiology groups and hospitals throughout the U.S.

• Cyberonics (Houston) reported that with the filing of its Quarterly Report on Form 10-Q for the period ended Oct. 27, 2006, it has now filed all previously delinquent reports to the Securities and Exchange Commission. The company also said it received a letter from The NASDAQ Stock Market confirming that it has regained compliance and continued listing of the company's securities on The NASDAQ Stock Market.
