Applied Biosystems Inc. has settled a patent infringement caseagainst Cruachem Inc. involving two patents covering compounds forbuilding synthetic DNA.
Applied Biosystems last week said that Cruachem of Sterling, Va.,admitted that it had infringed the patents and dropped itscounterclaims. Applied Bio said Cruachem and its parent, CruachemHoldings Ltd. of Glasgow, Scotland, also agreed to pay for pastinfringement and to accept a royalty-bearing sublicense.
The U.S. patents, No.'s 4,458,066 and 4,415,732, coverphosphramidite compounds and are exclusively licensed from theUniversity of Colorado. The Foster City, Calif., company(NASDAQ:ABIO) has granted nine licenses for the compounds to date.Cruachem is the fourth company to settle after litigation.
