Spinal device company Alphatec Holdings (Carlsbad, California), reported that the U.S.District Court in Boston has denied a motion by DePuy Spine (Raynham, Massachusetts), a division of Johnson & Johnson (New Brunswick, New Jersey), seeking a preliminary injunction against Alphatec’s sale and manufacture of the Alphatec Zodiac and Solanas polyaxial pedicle screws.

The motion was brought in a lawsuit against Alphatec that alleged patent infringement, and was filed by DePuy, the patent’s U.S. licensee, and Biedermann Motech (Schwenningen, Germany), the patent’s owner.

The patent infringement case remains pending.
