Rochester Medical (Stewartville, Minnesota) reported that it has formed a settlement agreement with C.R. Bard (Murray Hill, New Jersey) concerning litigation that Rochester filed in 2004 against Bard, TYCO International , TYCO Healthcare Group ; Novation , VHA and Premier Purchasing Partners .
Rochester is dismissing Bard from the suit, with prejudice, and Bard is paying Rochester $49 million, out of which Rochester will pay its attorney's fees. Rochester said that the impact of the settlement will be reflected in the current quarter's financials.
On Nov, 20, Rochester reported a settlement in the case with Premier. The litigation continues against the other defendants (Medical Device Daily, Nov. 21, 2006). It said that the case is scheduled for trial in May 2007.
Rochester manufactures disposable medical catheters and devices for urological and continence care applications.
