AcerMed (Irvine, California) reported that it has “successfully prevailed” before the U.S. District Court in connection with its motion to compel arbitration with MedInformatix (Los Angeles), in relation to a lawsuit filed against it by MedInformatix. AcerMed said the court granted its motion and ordered both parties to alternate dispute resolution before a duly selected arbitrator.

On its web site, MedInformatix reports “numerous complaints of 'bait and switch' tactics” regarding Acermed, which was its former distributor and the filing of legal action against AcerMed.

The web site information says: “The complaints have come from customers of AcerMed who allege they have been deceived by AcerMed's tactic of passing off installations which contain the MedInformatix suite of software products as their own and then representing that they have a 'new' version of the product which they will install for the customer. Not surprisingly, the 'new' AcerMed software often does not perform like the MedInformatix software which was demonstrated to the unsuspecting customer. MedInformatix has been advised by several victims that they have forced AcerMed into making refunds after the threat of legal action. If AcerMed purports to offer a 'demonstration' of its product, you should ascertain if AcerMed is showing the MedInformatix suite of software products. If that is the case, you will not be able to purchase the software which was the subject of the demonstration from AcerMed.”

AcerMed expressed confidence in prevailing “on all issues arising from MedInformatix's allegations” and that it will seek to recover all damages caused by MedInformatix.
