Federal Circuit kicks Nuvasive case back to PTAB for another look

The U.S. Court of Appeals for the Federal Circuit held another hearing involving a patent by Nuvasive Inc., of San Diego, for the company's Extreme lateral interbody fusion (XILF) system, during which the Federal Circuit vacated the Patent Trial and Appeal Board's (PTAB) finding of obviousness. The case isn't over yet, as the court remanded the case back to the board, where Nuvasive will have another chance to preserve the patent.

Vapotherm Inc. managed to get its IPO out, despite a tumultuous recent broader stock market. The Exeter, N.H.-based company raised $56 million by selling 4 million shares at $14 each, which was at the low end of its previously reported range. It plans to use the proceeds to expand its sales and marketing efforts, as well as to back further R&D.
